نظريه 860/7-28/3/1343 اداره حقوقي دادگستري:  ارجاع به داوري دو قسم ممكن است باشد:

1-   طرفين توافق مي كنند كه شخص يا اشخاص معيني به عنوان  داوري به دعوي رسيدگي كنند در اين صورت اگر راي داور يا داوران صادر و بنا به در خواست يكي از طرفين باطل شد، پس از قطعيت راي  قهرا” قرارداد نامه داوري هم از بين رفته محسوب است و دادگاه به اصل دعوي رسيدگي خواهد نمود مگر اينكه طرفين  مجددا” درخواست ارجاع امر به داوري را به اشخاص ديگر نمايند كه بنا به درخواست آنان قراردادنامه  ارجاع به داوري تنظيم ميشود.

2-   وقتي كه طرفين بدون در نظر گرفتن شخص بخصوصي درخواست ارجاع امر به داوري نموده اند و راي داور باطل شناخته شده است در اين صورت قراردادنامه داوري به حال خود باقي است و پس از قطعيت حكم بطلان راي داور   طرفين دعوت مي شوند  و در صورتي دادگاه به اصل دعوي رسيدگي مي كند  كه طرفين تراضي نمايند  والا به درخواست هر يك از طرفين اقدام به تعيين داور  مي نمايند.
